Balikbayan privilege - a year visa-free for the family travelling with you

Sino ang balikbayan?

The balikbayan programme is set out in Republic Act 6768, as amended by Republic Act 9174. The law defines a balikbayan as a Filipino citizen who has been continuously out of the Philippines for at least one year, a Filipino overseas worker, or a former Filipino citizen naturalised in a foreign country who comes or returns to the Philippines. Most of our customers are one of those three without ever having thought of themselves as a balikbayan.

The one that matters - a year visa-free for your family

Section 3(c) of the Act grants visa-free entry to the Philippines for a period of one (1) year for foreign passport holders, with the exception of restricted nationals. In practice this is the provision that lets a British husband or wife stay far beyond the ordinary 30-day visa-free window without applying for anything in advance.

The catch is in the definition of "family". The Act defines it as the spouse and the children of the balikbayan who are not balikbayan in their own right, travelling with the latter to the Philippines. Travelling with - the same flight, arriving together. A husband who follows a fortnight later does not get the privilege, and that is the single most common misunderstanding we hear. Carry your marriage certificate and the birth certificates of your children: the privilege is granted on arrival by the immigration officer, and it is granted on evidence.

The duty-free allowance, and the Christmas window

A balikbayan is also entitled to a tax-exempt purchase of up to US$1,500 at government-operated duty-free shops, plus a separate kabuhayan allowance of up to US$2,000 for livelihood tools. Purchases must normally be made within 15 calendar days of arrival - but under Section 4(a), from 15 November to 15 January that window extends to 30 calendar days. If you are flying home for Pasko, that is worth knowing before you spend. The privilege can be used once a year, it is not transferable, and it is for a balikbayan of majority age.

Balikbayan is not the same as travel tax exemption

These are two separate benefits and people conflate them constantly. The balikbayan privilege is an immigration matter - how long your foreign family can stay. Travel tax exemption is a TIEZA matter with its own evidence rules, covered on our travel tax page. You can very easily qualify for one and be asked for different paperwork for the other, so prepare for both.
